About these terms
What The Cuts is run by Faizul Rahman N as a sole proprietor in Tamil Nadu, India (“we”, “us”). These terms apply to all our services, including content strategy, AI video creation, editing, posting, account management and content audits, for the client named on the quote (“you”).
Your project agreement is the quote or proposal we agree in writing plus these terms. If the quote says something different from these terms, the quote wins for that project.
Quotes and scope
- Each project's scope, deliverables, formats, number of videos, timeline and price are agreed in writing, by email, WhatsApp or a signed proposal.
- A quote is valid for 30 days unless it says otherwise.
- Work outside the agreed scope is quoted separately before we start it.
- Timelines are estimates and depend on you sending materials and feedback on time. If these arrive late, the deadlines move.
Your materials
- You confirm that you own, or have permission to use, everything you send us: footage, photos, music, logos, fonts, scripts and the likeness of any person in them, and that using them in your project does not break any law or anyone else's rights.
- You are responsible for claims that arise from materials you supply, and you agree to cover our reasonable costs if such a claim is made against us.
- We use licensed or royalty-free music and stock, or the files you provide. In-app music on social platforms is subject to each platform's own rules.
- We use AI tools in our work. We only create the likeness of a real person with that person's permission, and you approve content before it is published.
Revisions
The number of revision rounds is set in each quote. If the quote does not say, each deliverable includes two rounds of revisions. A revision is a change within the agreed brief. New concepts, a changed brief or extra shoots are quoted as new work. Please send each round of feedback together, in writing.
Payment
Prices, any advance, due dates, currency and taxes are as stated on each quote or invoice. If a payment is late, we may pause work and hold back final files until it is paid. Bank or transfer charges on your side are yours to pay.
Ownership of the work
- Once you have paid in full, you own the final delivered files for the project.
- Until then, we own them and you may not publish or use them.
- We keep ownership of our project files, raw outputs, templates, presets and working methods unless the quote says we will hand them over.
- Third-party elements such as stock, music, fonts and AI tool outputs stay subject to their own licences.
Portfolio
We may show the work we made for you in our portfolio, website and social media, unless you tell us in writing that you do not want this. If your project is not yet public, we will wait until it is.
Confidentiality
We each keep the other's confidential information private and use it only for the project. This does not cover information that is already public. This duty continues after the project ends.
No guaranteed results
We work hard to make content that performs, but we do not guarantee views, followers, reach, engagement, leads or sales. Social platforms control their own algorithms.
Access to your accounts
If we post for you or manage your accounts, please give us access through the platform's own team or partner features where possible. You stay the owner and can remove our access at any time. We are not responsible for actions a platform takes against an account, such as removals or limits, unless we caused them by breaking these terms.
Cancellation
- Either of us can cancel a project by telling the other in writing.
- If you cancel, you pay for the work done up to that date and for costs we have already committed to for your project. If you have paid more than that, we refund the difference.
- If we cancel for a reason other than your breach of these terms, we refund what you paid for work we have not delivered.
Limit of liability
To the extent the law allows, our total liability for any claim about a project is limited to the fees you paid us for that project. We are not liable for indirect or consequential loss, or for lost profits, revenue or business opportunities. Nothing in these terms limits liability that cannot be limited by law.
Disclaimer
Content on our website, including case studies and examples, is for general information. Results shown for one client are not a promise of the same results for another.
Privacy
How we handle personal data is explained in our Privacy Policy.
Governing law and disputes
If a problem comes up, we will first try to resolve it by talking to you. These terms are governed by the laws of India, and the courts of Tamil Nadu have exclusive jurisdiction.
Changes to these terms
We may update these terms. The version that applies to a project is the one in force when its quote was agreed.
